Abstract
India's renowned software company Tata Consultancy Services (TCS) had attracted intense media attention during December 2022. A lawsuit was filed against TCS by one of its former employees Shawn Katz (Shawn) in the US. The lawsuit highlighted the fact that TCS had a strong culture of discrimination, and this affected various aspects associated with hiring decisions. The complaint filed by Shawn even claimed that the top-down culture of TCS promoted strong discrimination against a majority of non-South Asian recruits. The IT major had suffered a similar defamation during 2015, although a relief came from such allegations through US judiciary during 2018. Business experts noted that the Indian IT major had faced repeated allegations in the US market, including a complaint from Epic Systems (Epic), a healthcare domain software services' brand. Although the US jury ruled in favour of TCS during 2018 stating that the brand had never practiced a systematic pattern of discriminatory practices, the 'bribe-for-jobs scandal' unearthed in 2023 endorsed biased hiring practices in India, which was TCS's major market. With such allegations being unearthed continuously, would TCS sustain its status as an ethical employer?
