Abstract
This is the last of a three-case series (596-005-1 to 596-007-1) and takes the FTC v Kraft Inc cases (A) and (B) to the third venue - federal Court of Appeals. Thus, the Federal Trade Commission regulatory process moves out of the agency level into the federal courtroom. In January 1991 Kraft lost its appeal to the FTC - (B) case. Now, roughly a year later, Kraft is appealing the decision with an emphasis on the First Amendment right to free speech. In addition, Kraft introduces two new arguments - request for ''de novo'' review and Lanham Act precedent - which are not contained in the prior cases. It may be used alongside ''Borden Inc v Kraft Inc'' (595-043-1).
