Abstract

The case is concerned with the dismissal of a hospital porter for misconduct. He was subsequently found to be unfairly dismissed by an Industrial Tribunal. Some two years later the dismissed employee again applied to an Industrial Tribunal for assessment and reimbursement of the employee''s pension contributions. The case illustrates the Tribunal''s reasoning in calculating those contributions. (Such cases occur only infrequently, so this is interesting on that basis alone.) This case is designed to make clear the major provisions of the unfair dismissal legislation. Moreover, to illustrate how important it is that management should operate and follow proper procedures when disciplining and dismissing employees, in order to ensure that they act reasonably and within the requirements of the legislation. (Used in syndicate groups of about four in each group.)
