Abstract

The case discusses the liability of an insurer to a claimant with regard to medical expenses, which include all expenses incurred on emergency care, surgery, hospitalisation, drugs and transportation. The case also highlights the right of an individual to claim special damages as well as general damages. The case concentrates on how absence of negligence can act as a defence to liability claims. The case is structured to enable students to: (1) understand the elements of damage in injury claims; (2) know how to evaluate special damages as well as general damages in case of injury claims; (3) understand the insurer''s duty to defend its policyholders against lawsuits; and (4) identify problems in cases of damage for injury claims. The case is intended for MBA/PGDBM level students as part of the insurance operations curriculum.
